Anchor Into Presence Terms of Use

Welcome to Anchor Into Presence, operated by Mindfully Evolve LLC (“Company,” “we,” “our,” or “us”). By downloading, accessing, or using the Anchor Into Presence mobile application (“App”), you agree to these Terms of Use. If you do not agree to these Terms, please discontinue use of the App.
1. About the App
Anchor Into Presence provides guided meditations, daily reflections, and wellness content designed to support mindfulness, presence, and personal growth. The App is intended for educational and informational purposes only and is not a substitute for professional medical, psychological, or mental health care.
2. Eligibility
You must be at least 18 years of age, or the age of majority in your jurisdiction, to purchase a subscription and use paid features of the App.
3. Account
Certain features require creating an account. You agree to provide accurate information and keep your account credentials secure. You are responsible for all activity that occurs under your account.
4. Subscriptions
Anchor Into Presence offers auto renewing subscriptions through the Apple App Store and Google Play. Subscription options may include Monthly Membership, Annual Membership, and promotional subscription offers when available. Prices may vary by country and will be displayed before purchase.
5. Billing and Automatic Renewal
Payment will be charged to your Apple App Store or Google Play account upon confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours before the end of the current subscription period. You may manage or cancel your subscription through your Apple App Store or Google Play account settings. Deleting the App does not cancel your subscription.
6. Promotional Offers
From time to time, Anchor Into Presence may offer introductory pricing, promotional offers, or Founding Member pricing. Eligibility for promotional offers is determined by Apple App Store or Google Play and may be limited to qualifying users. Promotional offers cannot be combined unless expressly stated.
7. Refunds
All purchases are processed through the Apple App Store or Google Play. Refund requests are subject to the policies of the platform through which the purchase was made. Mindfully Evolve LLC does not issue refunds for purchases processed through Apple or Google.
8. Intellectual Property
All content within the App, including guided meditations, audio recordings, reflections, text, graphics, logos, branding, and other materials, is the exclusive property of Mindfully Evolve LLC unless otherwise stated. The content is provided for your personal, noncommercial use only and may not be copied, reproduced, distributed, modified, sold, or shared without prior written permission.
9. Acceptable Use
You agree not to copy or redistribute App content, reverse engineer the App, interfere with its operation, use the App for unlawful purposes, or share subscription access with others.
10. Availability
We strive to provide uninterrupted access to the App but cannot guarantee continuous availability. Features, content, pricing, and functionality may be updated, modified, or discontinued at any time.
11. Disclaimer
Anchor Into Presence is designed to support mindfulness, presence, and personal growth. The App does not provide medical, psychological, or therapeutic treatment. If you are experiencing a medical or mental health emergency, contact your physician or emergency services immediately.
12. Limitation of Liability
To the fullest extent permitted by law, Mindfully Evolve LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the App. Your use of the App is at your own discretion and risk.
13. Privacy
Your use of the App is also governed by our Privacy Policy, which is available separately on our website.
14. Changes to These Terms
We may update these Terms of Use from time to time. Updated versions become effective upon posting within the App or on our website. Continued use of the App constitutes acceptance of the revised Terms.
15. Governing Law
These Terms of Use are governed by the laws of the State of New Jersey, without regard to its conflict of law principles.
